Does your website need a privacy policy? 
What are the different options for adding one to your site?

If you collect any information on your website, then yes … you need a privacy policy. 

You know that Contact page that has a simple form that people can fill out to reach you? Yep. That requires you to have a privacy policy.

Currently, there are multiple privacy laws in the United States and across the world that require most websites that collect personal information to have a Privacy Policy:

  • European Union’s General Data Protection Regulation (GDPR);
  • United Kingdom’s Data Protection Act 2018 (UK DPA 2018);
  • Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA);
  • Australia Privacy Act of 1988; The California Online Privacy Protection Act (CalOPPA);
  • The California Consumer Privacy Act (CCPA); Delaware Online Privacy Protection Act (DOPPA);
  • Nevada’s Revised Statutes Chapter 603A; Colorado Privacy Act (goes into effect in 2023);
  • Virginia Consumer Data Protection Act (goes into effect in 2023).

These laws were created to protect the consumers of those states and countries, not the businesses. This means that these laws can apply to businesses outside of those states and countries and may apply to you if you do business there, collect the personal information of residents of those states or countries, or offer goods or services there.

Why you need to keep your privacy policy up to date:

Several states have proposed privacy bills that, if passed, would require websites that collect personal information to have a compliant Privacy Policy. These bills all have different requirements for the disclosures that need to be made in a Privacy Policy and would impose heavy fines for failing to include those disclosures. In fact, some states are proposing to allow consumers to sue businesses directly for not having a compliant Privacy Policy.

As a client, you have three (3) options to choose for your small business website:

  1. No privacy policy. You accept all responsibility.
  2. Create your own privacy policy using TermsFeed (free).
  3. Sign up for auto-updating, a professional privacy policy.

Option 01:
No Privacy Policy

You elect to have no privacy policy on your website.

Choosing this option means you also accept all responsibility that comes without a privacy policy.

Remember, if you have a contact form or a newsletter sign up on your website or if you’re connected with Google Analytics, you need to have a privacy policy. 

Option 02:
User Generated Privacy Policy

This option provides a robust privacy policy that has specific information regarding your website and business. 

You create the privacy policy by answering a few questions in a step-by-step wizard. You’ll have the chance at the end to select a professional option if you’d like. Otherwise, the privacy policy generator is free. You do have to submit your email address since that’s where they’ll be sending it to. 

Once you receive your privacy policy, simply send it to me and I’ll add it to your website, free of charge (clients only).

The best option for a comprehensive, robust privacy policy. 

The best part? Because privacy laws are always changing, this option will automatically update your policy as laws change. That’s freaking awesome. It’s the best privacy policy I’ve seen. In fact, it’s what I use on my website.
